Distance Sales Agreement

PARTIES

This Distance Sales Agreement (“Agreement”) has been concluded electronically between Gizem Gezen (“Seller”), operating at BURGAZ MAHALLESİ, EKİN SK. NO: 43 İÇ KAPI NO: 4 MİLAS/MUĞLA, and the person (“Buyer”) purchasing products and/or services through the website www.gigegallery.com.

The Parties acknowledge, declare, and undertake that they have read, fully understood, and approved all provisions of this Agreement.

The Seller and the Buyer shall individually be referred to as a “Party” and collectively as the “Parties.”

By purchasing products and/or services from the Seller, the Buyer acknowledges, declares, and undertakes that they have read, understood, and accepted all provisions of this Agreement.

ESTABLISHMENT OF THE AGREEMENT

• The Buyer acknowledges that they have read and understood the Agreement and are aware of their rights and obligations.

• The Parties agree that there is no disproportion between the mutual obligations stipulated under this Agreement and that all obligations are appropriate to the nature of the transaction.

• The Buyer confirms that all transactions carried out under this Agreement are in their own interest and that they voluntarily accept all conditions without any pressure, difficulty, or distress.

• The Parties accept that the provisions of this Agreement do not contain unfair terms and comply with applicable consumer protection legislation.

SUBJECT OF THE AGREEMENT

The subject of this Agreement is the determination of the rights and obligations of the Parties regarding the sale and delivery of products and/or services ordered electronically by the Buyer through the website www.gigegallery.com in accordance with the Turkish Consumer Protection Law No. 6502 and the Regulation on Distance Contracts.

PRODUCT / SERVICE INFORMATION

Product details, quantities, prices, shipping costs, and payment terms are specified during the checkout process and form an integral part of this Agreement.

PAYMENT & DELIVERY TERMS

The total order amount, including shipping fees and applicable taxes, shall be paid by the Buyer through the payment method selected during checkout.

Shipping carriers may include:

• Yurtiçi Kargo

• UPS

• or other logistics partners selected by the Seller.

Tracking information will be provided electronically once the order has been dispatched.

DELIVERY

Unless the product is custom-made or personalized according to the Buyer’s request, the ordered products shall be delivered within the legally prescribed period of 14 days, depending on the Buyer’s location and delivery conditions specified during checkout.

Delivery shall only occur after:

• this Agreement has been electronically approved by the Buyer, and

• the full payment has been successfully received.

If payment is not completed or is canceled by the bank, the Seller shall not be obliged to deliver the products.

If the fulfillment of the order becomes impossible, the Seller shall notify the Buyer within 3 days and refund all collected payments, including shipping fees if applicable, within 14 days.

BUYER’S DECLARATIONS & OBLIGATIONS

The Buyer acknowledges that they have reviewed and approved all preliminary information regarding:

• product specifications,

• pricing,

• payment terms,

• shipping costs,

• and delivery conditions.

The Buyer accepts that by approving the order electronically, they undertake the obligation to pay.

The Buyer is responsible for inspecting the products upon delivery. Products visibly damaged during shipment should not be accepted from the carrier.

If the Buyer is unavailable at the delivery address, the Seller shall not be held responsible for failed delivery attempts.

SELLER’S DECLARATIONS & OBLIGATIONS

The Seller is responsible for delivering the products completely, accurately, and in accordance with the order specifications.

The Seller reserves the right to supply a product of equal quality and price if the original product becomes unavailable, provided that the Buyer is informed and gives explicit approval.

RIGHT OF WITHDRAWAL

Consumers have the right to withdraw from the Agreement within 14 days without providing any reason and without paying penalties.

For product sales, the withdrawal period begins on the delivery date.

To exercise the right of withdrawal, the Buyer must notify the Seller in writing via:

The Seller shall refund all payments within 14 days following receipt of the withdrawal request.

EXCEPTIONS TO THE RIGHT OF WITHDRAWAL

The right of withdrawal does not apply to:

• personalized or custom-made products,

• products prepared according to the Buyer’s specifications,

• digital products delivered instantly,

• products unsuitable for return due to hygiene or protective packaging removal.

This includes custom fine art prints and personalized artwork orders.

INTELLECTUAL PROPERTY

All intellectual property rights related to:

• artworks,

• graphic designs,

• illustrations,

• visual elements,

• website content,

• product designs,

• and all materials displayed on the website

belong exclusively to the Seller and are protected under applicable intellectual property laws.

Purchased products may not be copied, reproduced, distributed, modified, resold, or commercially exploited without written permission from the Seller.

FORCE MAJEURE

Neither Party shall be held liable for delays or failures caused by events beyond reasonable control, including but not limited to:

• natural disasters,

• war,

• terrorism,

• internet outages,

• governmental actions,

• strikes,

• or logistics disruptions.

DISPUTE RESOLUTION

Any disputes arising from this Agreement shall be subject to Turkish law and may be resolved before the Consumer Arbitration Committees or Consumer Courts authorized under applicable legislation.

EFFECTIVENESS

This Agreement becomes effective electronically upon approval by the Buyer during checkout.

Electronic records maintained by the Seller shall constitute binding evidence in case of disputes.
